Trump's top finance chief was repeatedly pressed by House Democrats over his decision last week to refuse to turn over Trump's tax returns under an obscure law that specifies the Treasury secretary "shall furnish" the information requested by the heads of the tax-writing committees.
"Absolutely not", said Mnuchin during a House Financial Services Committee hearing.
While the IRS told the Post that the memo was never forwarded to Mnuchin, former IRS commissioner John Koskinen said in an interview with the New York Times that it would be "stunning" if the Treasury Secretary did not know about the document.
Mnuchin said he had been advised it would be unlawful to release the returns, and underscored that the memo that reportedly contradicted that advice had only been in draft form. He maintains that the committee is looking into the effectiveness of IRS mandatory audits of tax returns of all sitting presidents, a way to justify his claim that the panel has a potential legislative objective.
"That memo, as I understand, is addressing a different issue and is not addressing the issue that we and the Department of Justice looked at", he said.

Trump has long told confidants that he was under audit and therefore could not release his taxes.
Trump also likely wanted to keep his tax returns hidden thanks to the 1990 and 1991 worst businessman in America revelations unearthed by the NYT.
Several legal experts have argued the memo undermines Treasury's rejection of the tax returns.
"T$3 he Secretary's obligation to disclose return and return information would not be affected by the failure of a tax writing committee ... to state a reason for the request".
During Wednesday's hearing, Waters, at the request of Democratic Rep. Stephen Lynch of MA, said she would consult with the House general counsel on whether Mnuchin should be held in contempt for refusing to furnish Trump's tax returns.
In the event that Trump does invoke executive privilege to avoid handing over his tax returns, the president could be asked to justify it. Neal has already indicated he does not plan to take that step.
