Without Sessions' campaign or Russian Federation entanglements, there's no legal reason Whitaker couldn't immediately oversee the probe. The almost year and a half long investigation by the special counsel stems from allegations of Russian Federation coordinating with members of the Trump presidential campaign.

As the probe continued to cloud his presidency, Trump kept complaining about Sessions recusing himself from supervising Mueller and entrusting the task instead to Deputy Attorney General Rod Rosenstein.
The New York senator said he found the timing of Sessions's departure "very suspect".
Sessions was the first casualty of a cabinet shakeup that had been expected from Trump following the midterm elections.

In Catonsville, Baltimore County Executive Don Mohler, County Councilman Tom Quirk and County Council Chairman Julian Jones joined dozens of protesters calling for the independence and protection of Mueller's investigation into Russia, Trump and the 2016 election.

The move places the investigation in jeopardy, as Whitaker has previously expressed deeply critical views of it and may seek to end it altogether.
Trump announced that former Sessions chief of staff Matt Whitaker would serve as acting attorney general.
Whitaker now becomes Mueller's new boss and judging by past statements he will be sympathetic towards Trump. Whitaker accompanied the tweet with his own comment to his followers: "Worth a Read".
"We'll see what happens over the next few days, but it is a concern because (Preisdent Donald Trump) obviously was unhappy with Jeff Sessions because of his recusal, but Jeff Sessions did what the law required him to do", King said in an interview at the school. "That's where the left seems to be combining those two issues".
